Legal foundations of the activity of public associations on the territory of pre-revolutionary Kazakhstan

Abstract

The problems of forming a legal basis for regulating the activities of public associations of citizens in the second half of the XIX - early XX centuries are considered in this article on the territory of pre-revolutionary
Kazakhstan. The main evolutionary stages of lawmaking are analyzed, preceding the appearance on March 4, 1906 of the first in the history of the Russian Empire of a general law on public organizations - the «Provisional Rules on Societies and Associations». It is shown that public organizations were a kind of democratic
cells, formed in the Russian empire of civil and national consciousness, thereby contributing to the emergence of a nascent civil society. The reasons that prevent the appearance of the law on public associations in the initial period of their emergence have been identified and justified. Based on the conducted research, the authors concluded that the problem is urgent for modern participants of the social movement and civil servants, who are called upon to build relationships between the state and civil society.
